The Employer Nomination Scheme Subclass 186 Visa can be applied for by skilled individuals who intend to migrate to Australia as permanent residents. The visa encourages business owners from Australia to sponsor skilled workers from overseas for full-time positions in Australia. The visa can be further categorized into 3 main streams including Temporary Residence Transition Stream, Labor Agreement Visa Stream, and Direct Entry Stream.

Who is eligible for this visa?

To apply for this visa, the individual must first provide evidence that they have been running a successful business for at least two years in Australia. The visa holder can reside, work, and even study in the country.

Sponsored 186 Visa for Australia:

  • Must be less than 45 years of age when applying for the visa
  • Needs to be nominated by an approved Australian employer for a relevant occupation
  • Before the visa has been lodged, the individual must receive approval of nomination
  • Must hold the necessary skills including a license or registration for the position they have applied for

What this visa allows you to do in Australia?

The holders of this visa, i.e., skilled workers have the permission to stay in Australia for an indefinite period. After the individual has resided in Australia for a successive period, Australian citizenship can be obtained, and they are permitted to sponsor family members who meet the eligibility criteria, for PR in Australia.

Business Visa 892 can be obtained by only those individuals who fulfill the business, health, and character requirements, and most importantly, the provisional visa criteria.

Eligibility criteria for Employer Nomination 186 Visa

Visa applicants must meet the following criteria when applying for the Employer Nomination Subclass 186 Visa:

  • The individual must be able to speak fluent English
  • Pass the character test by providing evidence of clear criminal records, offensive convictions, and immigration detention
  • Hold appropriate skills for the selected occupation
  • Must possess the relevant skill for the nominated occupation

The visa permits holders to travel to and from Australia for a successive 5 year period. After 5 years, a Resident Return Visa will need to be applied if the individual wishes to travel

The processing time for an Employer Nomination Scheme Subclass 186 Visa application differs depending on the following streams:

  • Temporary Residence Transition Stream: 12 to 13 months
  • Direct Entry Stream: 11 to 18 months
  • Labor Agreement Stream: 12 to 13 months

It is permitted to include your partner (married or de facto), your child/ stepchild, or the child/ stepchild of your partner. You must include a verification of their relationship with you.

Whether you are in or out of Australia, you can apply for an ENS visa. If you reside in the country at the time of application, you must hold a bridging visa A, B, or C or a substantive visa.

You must inform about any changes that take place after your application has been filled. Changes could include death, birth, divorce, marriage, separation, or a new address or passport.

If you possess either of the following and have been working full time in Australia, then you are eligible for applying for the Temporary Residence Transition Stream (TRT):

  • Temporary Skill Shortage Subclass 482
  • Temporary Work Visa Subclass 457

If your employer wants to sponsor you and you meet the criteria of the TRT stream, you are eligible to apply for the Direct Entry Stream.

In the case where the individual’s employer has engaged in a labor agreement with the Division, that allows permanent residence, the Labor Agreement Stream can also be applied for.
